Conditions of Entry

  1. Information on how to enter and prizes forms part of these Conditions of Entry. Entry into the KOTEX Maternity Pads Pumpkin Patch Promotion (Promotion) is deemed to be an acceptance of these Conditions of Entry.
  2. Promotion commences 00:01 AEST on 1 July 2007 and entries close at last mail on 23 June 2008 (Promotion Period).
  3. Entry is only open to Australian residents. Employees (and their immediate families) of the Promoter, or agencies or companies associated with this Promotion, are ineligible to enter.
  4. For a chance to win send a validly completed entry form (available on specially marked packs of KOTEX maternity pads or from www.huggies.com.au) to “KOTEX Maternity Pads Pumpkin Patch Promotion” PO Box 343, Milsons Point NSW 1565. Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.
  5. You can enter more than once, but each entry must be in a separate stamped envelope. Each entry must be validly completed on an original entry form. Entry forms printed on-line at www.huggies.com.au must attach an original barcode from a pack of specially marked KOTEX maternity pads. Each barcode is valid for 1 entry only.
  6. All valid entries received during the periods set out in clause 7 will be placed in a draw for that period to be held at Kimberly-Clark Australia Pty Limited, 52 Alfred Street, Milsons Point NSW 2061 at 10am (AEST) on the dates set out in Clause 7. The first 3 entries drawn in each draw will win a $200 Pumpkin Patch voucher. Total prize pool is valued at $7,200.
  7. Draws will be held on the following dates
    1. Entries received 1/7/2007 – 31/07/2007 will be drawn on 13/08/2007 (Draw 1);
    2. Entries received 1/8/2007 – 31/8/2007 will be drawn on 10/9/2007 (Draw 2);
    3. Entries received 1/9/2007 – 30/9/2007 will be drawn on 8/10/2007 (Draw 3);
    4. Entries received 1/10/2007 – 31/10/2007 will be drawn on 12/11/2007 (Draw 4);
    5. Entries received 1/11/2007 – 30/11/2007 will be drawn on 10/12/2007 (Draw 5);
    6. Entries received 1/12/2007 – 31/12/2007 will be drawn on 14/1/2008 (Draw 6);
    7. Entries received 1/1/2008 – 31/1/2008 will be drawn on 11/2/2008 (Draw 7);
    8. Entries received 1/2/2008 – 29/2/2008 will be drawn on 10/3/2008 (Draw 8);
    9. Entries received 1/3/2008 – 31/3/2008 will be drawn on 14/4/2008 (Draw 9);
    10. Entries received 1/4/2008 – 30/4/2008 will be drawn on 12/5/2008 (Draw 10);
    11. Entries received 1/5/2008 – 31/5/2008 will be drawn on 9/6/2008 (Draw 11); and
    12. Entries received 1/6/2008 – 23/6/2008 will be drawn on 30/6/2008 (Draw 12).
  8. The Pumpkin Patch vouchers are redeemable at any Pumpkin Patch store. The terms and conditions specified by Pumpkin Patch (Australia) Pty Ltd (ABN 22 068 264 693) will apply to the redemption of the vouchers. The Promoter will not be responsible for lost or destroyed vouchers.
  9. The prize (including any unused portion) cannot be transferred, exchanged or redeemed for cash. The Promoter retains the right to substitute the prize with a prize of equal or greater value (including where the prize is unavailable), subject to approval of the gaming authorities in each State and Territory where relevant.
  10. The winners will be notified in writing by mail and telephone, and the winners’ names will be published in The Australian on the following dates:
    1. Draw 1 – 20/08/2007;
    2. Draw 2 – 17/09/2007;
    3. Draw 3 – 15/10/2007;
    4. Draw 4 – 19/11/2007;
    5. Draw 5 – 17/12/2007;
    6. Draw 6 – 21/01/2008;
    7. Draw 7 – 18/02/2008;
    8. Draw 8 – 17/03/2008;
    9. Draw 9 – 21/04/2008;
    10. Draw 10 – 19/05/2008;
    11. Draw 11 – 16/06/2008; and
    12. Draw 12 – 7/07/2008.
  11. The Promoter may conduct such further draws at 52 Alfred Street, Milsons Point NSW 2061 as are necessary at 10am on 6 October 2008 for any unclaimed prize, subject however to any directions given by any applicable gaming authorities and under Reg 37 of the Lottery and Gaming Regulations 1993 (SA). Details of the winners of any unclaimed prize draw will be notified in writing by mail and details of the winner of any unclaimed prize draw will be published in The Australian on 13 October 2008.
  12. Prizes will be delivered within 21 days of the draw.
  13. In the event that the prize is won by a person under the age of 18, the prize may be awarded to the winner’s parent or guardian.
  14. The Promoter’s decision is final, and no correspondence will be entered into, including in the event of a dispute. The prize must be taken as offered and cannot be varied.
  15. The Promoter reserves the right to validate and check the authenticity of entries and barcodes and to disqualify any entrant for tampering with the entry process, or who submit an entry that is not in accordance with these Conditions of Entry. Any entry made with stolen, forged, mutilated, unrecognised or tampered with entry forms or barcodes will be deemed void.
  16. The Promoter and its associated agencies or companies accept no responsibility for lost, late, stolen, damaged or misdirected entries.
  17. If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the terms of the Promotion including the prizes and these Conditions of Entry, subject to approval of the gaming authorities in each State and Territory where relevant.
  18. Any tax liability arising as a result of accepting any prize is the responsibility of the winner.
  19. The Promoter will not be liable for any injury, loss or damage of any nature whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained as a result of or in connection with receiving, taking or using any prize except for any liability which cannot be excluded by law.
  20. All claims and entries become the property of the Promoter. The Promoter requires your personal information in order to conduct the Promotion. If you do not provide the mandatory personal information requested then you will not be able to take part in the Promotion. By entering this Promotion, each entrant is taken to consent to the Promoter using the entrant’s personal information to administer the Promotion, announce the winners and disclosing the entrant’s personal information to organisations that assist the Promoter with administering the Promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this Promotion). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by entering the Promotion, the entrant is taken to consent to the Promoter’s privacy policy (which is available on request). By entering into this Promotion, each entrant also consents to the Promoter using their personal information for future marketing purposes, unless otherwise advised by the entrant. An entrant may access and correct any personal information held by the Promoter, upon request to the Promoter.
